Overtime and Night-Shift Pay in Brazil (CLT) 2026: How to Calculate

Overtime is any time worked beyond the agreed working day. Under Brazil's Constitution it is paid at least 50% above the normal hour; at night, between 10 pm and 5 am, a 20% night premium is added. Here is how to reach the right amount on the payslip.

1. Work out your hourly rate

Divide the monthly salary by the hours in the month. For the most common 44-hour week the divisor is 220 (200 for 40 hours a week, 180 for 36).

Example: a salary of R$ 3,300.00 ÷ 220 = R$ 15.00 an hour.

2. Add the premium

SituationMinimum premiumHour in the example
Overtime on a working day50% (Constitution, art. 7, XVI)R$ 22.50
Sunday or public holiday not compensated100% (double pay, Law 605/1949)R$ 30.00
Night hour (10 pm to 5 am, urban work)20% (CLT, art. 73)R$ 18.00

Collective agreements may set higher rates — check the one for your trade.

3. The night hour is shorter

In urban work each night hour counts as 52 minutes 30 seconds, so someone working from 10 pm to 5 am (7 clock hours) is paid for 8 night hours. When a night hour is also overtime, both premiums apply: R$ 15.00 × 1.20 × 1.50 = R$ 27.00. In rural work the premium is 25% and the night runs from 9 pm to 5 am (crops) or 8 pm to 4 am (livestock), without the shorter hour.

4. Include the weekly-rest add-on (DSR)

Regular overtime also increases the paid weekly rest. The usual sum: overtime pay of the month ÷ working days × Sundays and holidays.

Example: 10 overtime hours at R$ 22.50 = R$ 225.00. With 25 working days and 5 Sundays and holidays: R$ 225.00 ÷ 25 × 5 = R$ 45.00. Total: R$ 270.00.

Regular overtime also counts towards holiday pay, the 13th salary and notice pay, with FGTS deposits and INSS and income-tax deductions.

5. Limits and hour banks

  • The limit is 2 overtime hours a day (CLT, art. 59), except in exceptional cases set by law.
  • With an hour bank, extra hours become time off instead of money: compensated within 6 months under a written individual agreement, or within 1 year under a collective agreement. Hours not compensated in time are paid as overtime.
  • Managers with a bonus of at least 40% and staff without time control (art. 62) are generally not paid overtime.

Do the maths

The hours calculator adds up the week from clock-in and clock-out times, separates overtime day by day, handles shifts that cross midnight and prices the overtime. For the month's take-home pay, use the net salary calculator.

This guide covers the general CLT rules; collective agreements and specific cases may change the amounts. If in doubt, ask HR or your union.
